Recherche lexicographique en procédure civile - lexicographical research in civil procedure

Résumé
All experts in civil procedure have encountered difficulties when trans¬lating procedural concepts to English. There is not always an English equivalent to such concepts and even when an English term is correct, it is not always understood by practitioners in Common Law jurisdictions. There is, therefore, a need to review the most problematic terms and to reach some form of consensus among a few scholars regarding the best trans¬lation of particular procedural concepts. We have identified several terms that raise translational issues. We will define each of them, conduct a comparative law analysis and finally, propose possible translations of each term. The difficulty of legal translation is greater in procedural law as compared to substantive law, as every procedural rule fits into a tight set of effective judicial 'rituals'. It is not enough to identify the functional equivalent ; it is necessary that the translation must take into account the corresponding stage of procedure. When European principles of civil procedure are drafted in English and in French, translation difficulties generally shed light on problems of meaning and philosophy.
